Whoever told you that is wrong. Bail bonds can be posted 24-hours a day, 365-day a year, weekends and holidays included. In most cases the defendant’s bail bonds can be posted once they are fully booked into the system (this generally takes between 4 and 6 hours.) However, some Nevada jails require certain defendants (such as those who have been charged with domestic battery) see a magistrate judge before they can bond out. Other jails won’t accept bail bonds between midnight and 5 a.m., while others still might not allow defendants to be released at night if they don’t have a set ride home. The indemnitor on a bail bonds contract is also known as the bail bonds cosigner. By signing the bail bonds paperwork, they are agreeing to take on two legal responsibilities. One, the defendant will go to court as often as they need to in order to finish their case. Second, they are agreeing to make sure the bail bondsman’s fee is paid in full. Should the defendant skip bail (and skip town) and the bondsman (and cosigners) cannot get them back into the system in a set period of time, the indemnitor will be responsible to pay the defendant’s full initial bail amount to the court as a penalty. If the person who is supposed to be making the bail bonds payments falls behind, the responsibility to pay will fall to the indemnitor.
The bail bonds premium is the fee that is owed to the bondsman for their services. This fee is considered to be earned in full at the time the defendant is released from jail. It’s not something that will be refunded, in part, or in full, no matter what happens with the defendant’s case. Premium for a Bond in Las Vegas is 15% of the amount of the Bond.
